Acceptance, eligibility and accounts

These Terms and Conditions (“Terms”) are an agreement between you and Axiomintel, Inc., a Delaware corporation (“Axiom4Intel,” “we,” “us”), governing your use of the Axiom4Intel website at axiom4intel.com, the PaiAR™ (Personal AI Accountability Rating) platform, and related features including Connect, fAIls, Inform and Empower (the “Service”). By using the Service you agree to these Terms and our Conditions for Use, which are part of these Terms. Our Privacy Policy explains how we handle personal information. If you use the Service for an organization, you agree on its behalf and confirm you have authority to do so.

• Eligibility. You must be at least 18 and able to form a binding contract.
• Accounts. Provide accurate information, keep your credentials secure, and tell us promptly at [email protected] about any unauthorized use. You are responsible for activity under your account.
• One person per account. Accounts may not be shared, sold or transferred. Enterprise plans may include multiple authorized users.
• Changes to the Service. We may add, change or remove features. We will give reasonable notice of changes that materially reduce paid features.

Ratings, comparisons and published information

Axiom4Intel is an independent rating service. Our purpose is to evaluate, rate, rank and compare AI products and to publish the results to our users at axiom4intel.com.

• Available to account holders. PaiAR scores, grades, tiers, dimension scores, rankings, the Fickle Index, fAIls nominations, news links and research are published to everyone with an Axiom4Intel account. Account holders may view, compare, cite and discuss them, and share them outside the Service, including on social media. AI products and the companies that make them are named and compared side by side.
• Comparisons and rankings. We compare AI products against each other and against our methodology. A product’s score or rank reflects our assessment at a point in time and relative to other products. A product’s rank can change because of methodology updates or changes in other products’ scores, even if that product has not changed.
• fAIls nominations. Axiom4Intel nominates and publishes fAIls: documented instances of AI failure, misuse or harm involving named products. Nominations are our editorial selections, based on public reporting and the sources we cite. A nomination is not a finding of legal liability, fault or wrongdoing.
• News links. We link to and briefly summarize third-party news articles about AI products. We do not author, control or endorse linked content, and its original publisher is responsible for its accuracy and availability. A link does not mean the publisher endorses Axiom4Intel.
• Not professional advice. Nothing in the Service is legal, regulatory, compliance, security, procurement or investment advice. Make your own evaluation and consult qualified advisors before relying on a rating for any decision, including EU AI Act compliance.
• Information changes. AI products, policies and litigation change quickly. Ratings may lag those changes, and our methodology, dimensions and weights may be revised over time. Past scores may be restated.
• No affiliation. Product names, logos and trademarks of rated AI products belong to their owners and are used only to identify those products. Their appearance does not imply affiliation with or endorsement by those owners. Rated companies do not pay for, and cannot purchase, a score, ranking or the removal of a fAIls nomination.
• Corrections. If you believe a rating, fAIls nomination or news summary relies on a factual error, contact [email protected] with supporting evidence. We review submissions under our corrections process but retain sole editorial judgment over what we publish. Concerns about content posted by users are handled under the Conditions for Use.
• Sharing and social media. Ratings, pages and posts on the Service can be linked to or shared on third-party social media by account holders. Your use of those platforms is governed by their terms, and content shared there may be seen, copied and discussed outside our control.

Enterprise and API access

Enterprise accounts let businesses view, search and analyze content on the Service, including user posts about their products and companies. API access lets approved organizations search our data sets. Both are governed by a separate written agreement, which controls if it conflicts with these Terms. API licensees may not re-identify users, train AI models on our data, or redistribute it beyond what their agreement allows.

Plans, fees and cancellation

• Free and paid access. An account is required to use the Service. A free account is available. We may introduce paid plans in the future; if we do, their features and prices will be shown before purchase, and we will not move features from the free tier behind a paywall without notice. The terms below apply only if you buy a paid plan. Enterprise and API plans are governed by separate agreements.
• Billing. Paid-plan fees are charged in advance through our payment processor, in US dollars, exclusive of taxes. You authorize recurring charges until you cancel.
• Auto-renewal. Subscriptions renew automatically for the same term unless you cancel before the renewal date. We will send a renewal reminder where the law requires.
• Cancellation. Cancel anytime in account settings. Access continues to the end of the paid period. Fees are non-refundable except where the law requires or we state otherwise. EU/UK consumers have a 14-day right to withdraw, which ends once you begin using paid features with your consent.
• Price changes. We will give at least 30 days’ notice of price changes, effective at your next renewal.
• Non-payment. We may suspend paid features if a charge fails.

Acceptable use

You may use the Service only for lawful purposes and in line with these Terms. You agree not to:

• Scrape, crawl, bulk-download or systematically extract ratings, scores, measures or research, except through features or APIs we provide for that purpose.
• Use Service content to train, fine-tune or evaluate AI models, or to build a competing rating or index product.
• Republish or redistribute PaiAR scores commercially without our written permission. Non-commercial citation with attribution and a link is permitted.
• Attempt to manipulate ratings, Connect discussions or fAIls suggestions, including through fake accounts, coordinated campaigns or undisclosed paid posting on behalf of a rated company.
• Probe, scan or test the vulnerability of the Service, or bypass security or access controls.
• Interfere with the Service, including by introducing malware or overloading our systems.
• Impersonate any person or organization, or misrepresent your affiliation.
• Misrepresent a PaiAR rating, for example by altering a score, implying a certification, or using our marks to suggest endorsement.
• Violate our Conditions for Use when posting content.

Intellectual property

• Our content. The Service, including the PaiAR methodology, scores, measures, data model, research, software, design and text, is owned by Axiom4Intel or its licensors and protected by intellectual property laws.
• Your license. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, under these Terms and your plan.
• Trademarks. Axiom4Intel, PaiAR, Fickle Index, fAIls and related names and logos are our trademarks. You may not use them without permission, except to refer accurately to our ratings.
• User Content. You keep ownership of content you post (“User Content,” as defined in the Conditions for Use). The license you grant us is set out in the Conditions for Use.
• Feedback. If you send suggestions or feedback, we may use them without obligation to you.
• Copyright complaints. Send notices under the Digital Millennium Copyright Act to our designated agent as described in the Conditions for Use.

Disclaimers, limitation of liability and indemnity

User Content

Axiom4Intel is not responsible for User Content and does not adopt or endorse it. The user who posts User Content is legally responsible for it, as set out in the Conditions for Use. Our right to review or remove User Content does not create a duty to monitor or remove it.

Limitation of liability

Some jurisdictions do not allow these exclusions; in those places they apply only to the extent permitted. Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence, or rights consumers cannot waive.

Indemnity

You will defend and indemnify Axiom4Intel and its officers, employees and agents against third-party claims arising from your User Content, your misuse of the Service, or your breach of these Terms.

Termination, disputes and general terms

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, create legal risk for us, or if we discontinue the Service. Sections that by their nature should survive (including 2, 5, 6 and 7) survive termination.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. EU/UK consumers also keep the protection of mandatory laws where they live.

Global access

The Service is operated from the United States and is accessible worldwide. If you use it from outside the US, you do so on your own initiative and are responsible for complying with local laws.

Informal resolution

Before filing a claim, contact [email protected] and give us 30 days to try to resolve it.

Arbitration (US users)

Venue

Claims not subject to arbitration will be brought exclusively in the state or federal courts located in Virginia Beach, Virginia (the federal courts of the Eastern District of Virginia), and each party consents to that forum and venue.

Changes to these Terms

We may update these Terms. We will give at least 30 days’ notice of material changes; continued use after they take effect means you accept them.

General

These Terms, the Conditions for Use and any order form are the entire agreement. If these Terms and the Conditions for Use conflict, these Terms control, except that the Conditions for Use control on rules for posting, reporting and removing User Content. A separate enterprise or API agreement controls as stated in Section 2. If a provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
